BD2,200 Loan Claim Rejected
A civil court rejected a man’s BD2,200 claim against another person after he failed twice to appear and take a decisive oath ordered by the court. The claimant said he had lent the defendant BD2,200, while the defendant maintained that the actual loan was BD400 and that a BD2,400 debt document was signed only as a guarantee. The defendant asked the court to require the claimant to take an oath confirming that the full amount was given as a loan. The Court of First Instance directed the claimant to take the oath, but he failed to attend on the scheduled date and did not appear when given another opportunity. The court therefore dismissed the claim and ordered him to pay the expenses and legal fees. The claimant appealed, arguing that his absence should not be treated as a refusal because he had previously asked to change the wording of the oath.
