Judicial cooperation between nations mooted

MP Jamal Dawood proposes to have bilateral agreements in the field of judicial cooperation between Bahrain and countries of majority of expats residing in the Kingdom.

The proposal brings up the issues of allowing the transfer of convicted persons to undergo their sentenced punishment in the countries they belong.

Due to the increased number of foreign expatriates residing in the Kingdom of Bahrain and especially coming from certain countries in order to work, the involvement of many of them in criminal cases punishable by penalties of deprivation of liberty requires them to be placed in correctional and rehabilitation institutions for the period of the punishment.

But due to the limited capacity of the reform and rehabilitation centres, and the difficulty of providing rehabilitation programmes and reform in different languages and cultures, it is appropriate to have bilateral agreements with their countries.

The proposal will allow the sentenced person and his country make the request to be transferred and complete the sentence in their homeland.

This proposal follows along the lines of legislative decree No. 2 of 1998 between the Kingdom of Bahrain and the Arab Republic of Egypt, as well as legislative decree No. 4 of 2008 between Bahrain and the Gulf Cooperation Council, which allowed to have the sentenced individual to be transferred and complete their sentence in their homeland.
