Two defendants convicted over assault that left victim with serious head injuries
The Court of Cassation upheld three-year prison sentences against two defendants convicted of assaulting two victims during a fight, leaving one with serious head injuries requiring surgery.
According to the case details, the first victim suffered an epidural haematoma, bleeding in the brain, skull and nasal fractures, as well as bruises and abrasions to his face, neck and knee. Medical reports also indicated injuries consistent with pressure being applied to his neck.
The victim underwent surgery under general anaesthesia to remove the epidural haematoma and remained under medical observation until his condition stabilised. His treatment period was estimated to exceed 21 days.
The Public Prosecution charged the defendants with assaulting the bodily integrity of the two victims and causing injuries that resulted in the first victim being unable to carry out his personal activities for more than 20 days.
The Lower Criminal Court sentenced both defendants to three years in prison, with BD500 bail for each to suspend execution of the sentences. The High Criminal Court later upheld the ruling on appeal.
The Court of Cassation has now rejected the appeals on their merits and upheld the three-year sentences.
