Court rules former wife’s claim against ex-husband was time-barred

The Fourth High Civil Court rejected a Bahraini woman’s claim for BD66,000 from her former husband over her contribution to building their marital home around 27 years ago.

The court ruled that the claim was time-barred, noting that the couple’s divorce took place in 2010, more than 15 years before the lawsuit.

The woman had argued that she contributed to construction of the house and presented a notarised declaration from her former husband acknowledging her contribution.

The court noted that she had already filed an urgent case in 2011 concerning the works, demonstrating that there was no legal or moral impediment preventing her from pursuing her rights.

It ruled that the earlier urgent proceedings did not interrupt the limitation period because they did not include a direct request for payment of the claimed amount.
