Sydney: Australian toxic mushroom killer Erin Patterson has launched a major court appeal in Melbourne this Wednesday to overturn her widely publicised triple-murder conviction and life sentence.
The 51-year-old was found guilty last year of murdering three of her in-laws and attempting to kill a local pastor by serving them a lethal death cap mushroom beef Wellington in 2023. Following the trial, a judge handed her a life sentence with a 33-year non-parole period.
During the two-day hearing before three Court of Appeal judges, Patterson’s defense claims she suffered a ‘substantial miscarriage of justice’.
Watching via live video link from prison, her lawyer argues the trial judge wrongly admitted prejudicial cellular data and social media posts while improperly excluding other digital evidence. The defense also alleges fundamental irregularities involving the sequestered jury and an unfair cross-examination.
Concurrently, the prosecution is mounting its own counter-appeal against the judge's sentencing decision. Prosecutors are demanding a stiffer penalty, arguing that the 33-year non-parole period is ‘manifestly inadequate’ for the severity of the crimes.
